Employers in Canada are required to obtain a letter from Employment and Social Development Canada (ESDC)/Service Canada approving the temporary employee’s employment. A Labour Market Impact Assessment (LMIA) is what this is. A temporary foreign worker may be hired by an employer when a labour market impact assessment (LMIA) has been completed. It demonstrates that there is a need for an outsider to fill the position because no Canadians are available to do so.

The application for a work permit based on the LMIA is of two steps.

  • Applying to Service Canada for an LMIA is the initial step.
    • The LMIA is designed to make sure that competent Canadian citizens and/or permanent residents are not preferred over foreign workers. Employing foreign nationals in the designated occupation and at the designated workplace is likely to have a positive or neutral effect on the Canadian labor market, according to positive LMIA.
  • Once an employer has received a favorable LMIA from Service Canada, the next step is to submit an application for a work permit. Applications for work permits are sent to Immigration, Refugees and Citizenship Canada (IRCC).
